1. Introduction
These Terms and Conditions (“Terms”) govern your use of the VerifiedLocation website, services and mobile applications (collectively, the “Service”), operated by IBEX Technology Ltd (“we”, “us”, or “our”).
By accessing or using the Service you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must not use the Service.
You must be at least 18 years old to use this Service.
2. Description of the Service
VerifiedLocation is a software-as-a-service (SaaS) platform that allows users to publish a record intended to demonstrate that:
- they were physically present at a location
- they personally captured images using a mobile device
- the capture process was performed by a real human
To do this, our mobile application may:
- collect GPS coordinates or other device-provided location data
- collect device motion and sensor data
- capture photographs using the device camera
- analyse images and motion patterns to detect attempts to fake or replay imagery
- upload selected photographs and location information to our website
After verification, users may publish a “Verified Location” which can be publicly viewed by anyone.
The Service provides evidence-style information, not a legally certified proof of presence.
We make reasonable efforts to detect spoofing or manipulation, but we do not guarantee accuracy.
What Verified Location does not do:
- does not perform facial recognition
- does not identify users against databases
- does not track users in the background
- does not monitor user movement
- does not provide law enforcement services
The Service analyses images and device sensor data strictly to distinguish live capture from replay or static images, and not to establish or verify your legal identity.
3. Eligibility
You confirm that:
- you are at least 18 years old
- you will not allow anyone under 18 to appear in captured images
- you will not capture or upload images of minors
- you will comply with all applicable local laws
We reserve the right to request proof of age and suspend or terminate accounts where age cannot be verified.
4. User Responsibilities
You agree that you will:
- provide genuine location data
- capture photos of yourself only during verification
- not impersonate another person
- not use altered, modified, rooted, jailbroken, emulated, or virtual devices
- not use GPS spoofing tools, simulators, VPN location manipulation, or replayed video/images
- not upload illegal, offensive, hateful, threatening, sexual, or abusive content
- not include nudity in captured or uploaded images
- not attempt to interfere with or reverse engineer the Service
You must use a genuine operating system and an unmodified version of the app obtained from an official app store.
Failure to comply may result in immediate suspension or permanent banning.
Our decision on spoofing or misuse is final.
5. Verification Limitations
VerifiedLocation performs automated checks designed to detect common spoofing or replay attempts.
The system is not infallible and does not provide certified identity verification or legal proof of presence.
We attempt to determine whether:
- a device is physically present at a location
- the images were captured live
- the subject is a real human
However:
- mobile devices may report inaccurate location data
- operating systems may restrict sensor access
- sophisticated spoofing may not always be detected
Therefore, a Verified Location is not guaranteed to be correct and must not be relied upon as legal proof, evidence in court, or a certified identity or attendance record.
6. Public Publication
When you publish a Verified Location you acknowledge:
- your selected photographs may be publicly viewable
- your location (exact or approximate) may be publicly viewable
- your verification link and QR code may be shared by others
Although we provide options such as blurred images and approximate locations, you accept that technical faults or human error may result in unintended visibility.
Users control what elements are publicly released (photos or location precision), and we are not responsible for user choices. You publish information at your own risk.
7. Accounts and Login
Accounts are accessed using email login links or stored one-click login links.
You are responsible for keeping your email account secure. Anyone with access to your email may access your account.
We do not use passwords and cannot be responsible for access resulting from email compromise.
8. Data Storage and Retention
Your uploaded data, including photographs and location records, is stored:
- on our own servers
- on our computer systems
- using third-party storage providers
We use reasonable efforts to preserve data. However we do not guarantee storage.
Data may be lost due to:
- hardware failure
- software errors
- hacking
- corruption
- third-party provider failures
- system maintenance
- accidental deletion
We are not liable for loss or corruption of stored data.
If you cancel your subscription, fail payment, or delete your account, your stored data may be permanently deleted without notice.
You are responsible for keeping your own copies.
9. Subscriptions and Payments
The Service is provided on a subscription basis.
Payments are processed by Stripe. We do not store your card details.
You must ensure valid payment details remain active.
If payment fails:
- your access may be restricted
- your content may be removed
- your stored data may be deleted
Subscription fees are non-refundable except where required by law.
10. Fraud, Abuse, and Chargebacks
If you:
- initiate a payment chargeback
- falsely claim unauthorized use
- attempt to avoid payment
we may:
- suspend or permanently ban your account
- delete your content
- recover all outstanding fees
- recover administrative, legal, and payment processing costs
You agree to reimburse IBEX Technology Ltd for any chargeback fees, penalties, or recovery costs incurred.
11. Bans and Enforcement
We may suspend or terminate your account at any time if we believe you:
- attempted to spoof your location
- attempted to fake imagery
- violated these Terms
- abused the platform
No refund will be provided where a ban occurs due to misuse or attempted deception.
12. Device Compatibility
We do not guarantee the Service will function on all devices.
The app may:
- refuse verification
- reject certain devices
- block altered operating systems
- fail due to hardware limitations
You must confirm compatibility before purchasing a subscription.
13. User Content
You retain ownership of your photos and content.
However, by uploading or publishing content you grant IBEX Technology Ltd a worldwide, non-exclusive, royalty-free licence to:
- store
- process
- analyse
- display
- publish
that content for the operation of the Service.
You are solely responsible for the legality of the content you upload.
14. Profiles
Where we allow users to add:
- profile descriptions
- additional photos
- external links
You must not upload or link to misleading, illegal, defamatory, or harmful content.
We are not responsible for third-party links or user-generated content.
15. Analytics and Cookies
We use cookies and analytics services to operate and improve the website.
By using the Service you consent to necessary cookies required for operation.
16. Limitation of Liability
To the maximum extent permitted by law:
IBEX Technology Ltd is not liable for:
- incorrect verification results
- spoofed or manipulated records
- reliance on published locations
- data loss
- service interruptions
- device incompatibility
- unauthorized account access
- third-party service failures
The Service is provided “as is” and “as available” without warranties of any kind.
We implement reasonable technical and organisational security measures; however no system is perfectly secure.
Our total liability shall not exceed the amount you paid to us in the previous 12 months.
Nothing excludes liability for death or personal injury caused by negligence where prohibited by law.
17. Indemnity
You agree to indemnify and hold harmless IBEX Technology Ltd against any claims, damages, losses, costs, or legal expenses arising from:
- your misuse of the Service
- your published content
- your violation of these Terms
- disputes with other users
18. Changes to the Service
We may modify, suspend, or discontinue any part of the Service at any time without notice.
19. Changes to These Terms
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
20. Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
